Montano filed writ on Oct 5 suing NHA, Garcia
A writ, which bears a signature above the name Robin Montano, was filed on October 5 in the High Court in the matter of Neil Sammy, (former NHA employee) versus the NHA and CEO Noel Garcia. on Tuesday, Montano said he had prepared an affidavit on the matter, but it had not been filed in any court. Newsday yesterday secured a copy of the writ which bears the stamp of the Supreme Court of Judicature and which is dated October 5, 2004. The document states it has been filed by “Robin Montano, Montano and Co, Plantiff’s attorney-at-law.” Sammy is seeking $929,151.20 as well as damages for breach of contract, aggravated damages for pain and harassment caused by breach of contract. On Tuesday, Housing Minister Dr Keith Rowley called on the Senate to send Robin Montano before the Disciplinary Committee for his blatant violation of the advocacy rule, which states that “no member shall advocate any matter on behalf of any individual by means of a speech in Parliament in consideration of any fee, direct or indirect.”
Rowley noted that Montano had produced a document in the Parliament purporting to come from the NHA, but which was a “fraud” and “forgery.” Rowley explained that the man, who was Montano’s client, was suing the NHA and that Montano had prepared an affidavit for him on the basis of the very fraudulent memos which he waved so boldly in the Parliament. “Here you have a sitting Senator who prepares an affidavit, files a writ, brings it to the Parliament, stands up in the Parliament, prosecutes the case, present exhibits,” Rowley said. Yesterday, the NHA backed the claim that the document was bogus saying there was no date stamp on the document. It also stated that “on close examination, the font differed from the font” used on official NHA documents and that the numbering on pages 1 and 2 of the fraudulent document was different from the numbering on Page 3.
