Worker wins fight for top cesspit position

WAZIR MOHAMMED has won his High Court battle to become supervisor of cesspits. Mohammed’s judicial review case came up for hearing in the San Fernando Third Civil Court yesterday. He had sued the Statutory Services Authority Commission (SASC) for refusing to appoint him to the post. Mohammed’s attorney Anand Ramlogan told Justice Peter Jamadhar his client received word of his promotion on Tuesday from SASC. Jamadhar however granted a declaration that Mohammed was treated unfairly contrary to the principles of fundamental fairness by reason of the continuing failure and/or refusal of the SASC to promote him to supervisor of cesspits.


Mohammed, an employee for the past 26 years at the San Fernando City Corporation, was granted leave last week by Jamadhar to seek judicial review of his non-promotion to the post. Mohammed, 45, of Borde Narve Village, near San Fernando, challenged the SASC’s failure to promote him, having acted twice as supervisor of cesspits. First it was for eight months in 1995, and then between March 1, 1997, until November 19, 2004. In his lawsuit, Mohammed contended that in October 2004, another employee with less than three years of experience was promoted to the post, while he was reverted to his position of clerk II. Mohammed also stated that several letters to the SASC on his failure to be promoted were not answered. Jamadhar yesterday ordered that the respondent SASC pay Mohammed’s legal costs.
