Magistrate scolds prosecution in murder case
Earle-Caddle said it was the responsibility of the prosecution to obtain the requisite statements from witnesses and that after the matter, which began under former Chief Magistrate Marcia Ayers-Caesar, had been restarted twice, she expected all statements to be filed, citing the length of time Alexander had been in custody.
“This matter has been on the list since 2013. Why are we in August 2017 after the matter has been restarted twice still looking for witness statements? You all (prosecution) knew that something was going to have to happen with respect to the matter here today.” Matura-Singh explained that the reason for the delays in filing the statements came as the two witnesses had relocated from their homes without informing the investigating officer. She said that officers were working to relocate the witnesses.
Despite the absence of the statements, Matura- Singh assured the court she was prepared to continue with the proceedings as she was in possession of five statements and had the complainant in the matter available to provide testimony.
However, Earle- Caddle was not prepared to receive incomplete statements.
“I don’t want to hear that you are ready to tender what you have, I want to hear that you have all of your statements together.” Alexander was charged with one count of murder, one count of possession of a firearm, one count of possession of ammunition and one count of robbery. The charges were laid indictably by Earle-Caddle and Alexander was not called upon to enter a plea.
In 2013, Alexander, now 28, was accused of robbing Anton’s Gold Rush in Aboutique mall, Port of Spain, during the robbery he allegedly shot and killed security guard, John Adams, before escaping with eightythree gold pendants valued at approximately, $120,000. The matter has been adjourned for August 21.
