No injunction for farmers
Justice Nolan Bureaux yesterday refused to grant an injunction filed by farmers of Ramgoolie Trace, Curepe, to prevent the National Housing Authority from proceeding with a house construction programme on the site.
Justice Bureaux contended that construction work had progressed to the extent where it had gone too far to prevent the NHA from continuing. The farmers argument was that the work on the site had escalated only after they had filed for judicial review on July 15, 2003. The farmers did get leave for judicial review, but failed yesterday to get the injunction. They filed for judicial review after NHA re-took State lands they had been cultivating for many years to turn it into a residential area. Attorneys Ramesh Lawrence Maharaj, SC, Garnet Mungalsingh and Darrel Allahar, who represent the farmers, are expected to appeal Bureaux’s ruling.
