OAS ordered to pay contractor
The order was made by Justice Joan Charles. The Brazilian firm, in addition to it’s growing debts to subcontractors, has to pay TTR’s owner businessman, Clint Arjoon, the sum of $2,138 386.48 which was left unpaid by the contractor when it closed its operations last year. Arjoon was contracted by OAS to supply portable toilets, tent, chairs and Hiab trucks during the construction of the Point Fortin extension of the Sir Solomon Hochoy Highway.
In a claim for $7,962,507.00 filed by his attorneys Senior Counsel Anand Ramlogan SC and Alvin Pariagsingh, Arjoon stated that he had dutifully complied with the instructions from OAS and provided services to OAS during the period January 01, 2012 to September 22, 2015.
OAS failed to honour its obligation to pay and Arjoon indulged the company by granting several extensions of time to facilitate the promised payment which never materialised.
Arjoon exhibited to his claim, email correspondence between himself and OAS as evidence to prove that OAS had acknowledged the debt owed to his company.
On April 28, Arjoon said out of frustration he was forced to file a claim in the High Court. He has claimed aggravated and exemplary damages because OAS terminated the contract with his company when it filed legal proceedings to protect its legal rights.
Charles ruled in favour of Arjoon that based on the Defence of OAS the sum of $2,138, 386.48, was not in dispute and immediately ordered OAS to pay that sum and costs in the sum of 89,352.81; the balance of the claim remains pending and will be deal
