Guard on trial for co-worker’s murder
A SECURITY guard yesterday went on trial at the Port-of-Spain Second Criminal Court for the murder of his co-worker. Arnott Fabien, 39, of Petit Bourg, San Juan, is before Madame Justice Alice York Soo Hon charged with the January 7, 2003, murder of Victor McDonald. Both men were employed as security guards with Imjin Security Services. The State’s case is that on the fateful day, the duo was on duty at the NHA Complex in Patna Village, Diego Martin, when they began arguing in the sentry room.
"McDonald slapped Fabien in the presence of Estate Sgt Reynold Ramlal, who ordered Fabien to leave the room. The accused stepped out of the room and the deceased followed shortly after. Ramlal saw McDonald throw his hands in the air and shout “shoot mih nah,” before a loud explosion was heard. Another employee, Olson Roberts, saw Fabien pull out his firearm and fire at McDonald.
At the time of the shooting the deceased was unarmed. McDonald was rushed to the Port-of-Spain General Hospital, where he was pronounced dead. A post-mortem report revealed he died of a gunshot wound to the chest. Four State witnesses yesterday told the court that Fabien and McDonald had a stormy relationship. Security officer Lawrence Diaz, who worked with the two at the NHA Complex, testified that on the day in question, Fabien relieved him from duty at 5.45 am and took possession of a gun and 12 rounds of ammunition. He said the accused placed the firearm in his bag. Diaz said he had witnessed the accused and the deceased arguing on more than one occasion.
The company’s Managing Director Imsha Mohammed said he was aware that there was a problem between Mc Donald and Fabien.
Under cross-examination by Fabien’s attorney Ian Stuart Brook, Mohammed said Fabien performed his duties satisfactorily and never had to be disciplined. State attorneys Candia James and Cheron Raphael prosecuted. Hearing resumes today.
