Naraynsingh appeals
ATTORNEYS representing freed murder accused housewife Seeromani Maraj-Naraynsingh, yesterday filed a motion in the Court of Appeal, seeking among other things, an order to stop the State’s appeal against the dismissal of the murder charge.
The motion was filed yesterday in the Court of Appeal which has fixed May 22, for the hearing of the matter.
Maraj-Naraynsingh is seeking an order that the appeal filed by the State on February 6 be stayed. Alternatively, she is asking that the said appeal be withdrawn and/or stayed and/or be directed to remain on file and not be proceeded with.
Maraj-Naraynsingh, wife of prominent vascular surgeon Dr Vijay Naraynsingh, and San Fernando businessman Elton Ramasir, were freed by Justice Herbert Volney in the San Fernando High Court on January 26.
They had been on trial before a jury for the murder of Dr Naraynsingh’s first wife Chandra on June 29, 1994 outside the Langmore Health Foundation at Palmyra, San Fernando.
They were freed after the jury, on the invitation of the trial judge, said they did not wish to hear any more evidence.
The State filed an appeal on February 6. Along with the appeal, the Attorney General filed a reference on the point of law. But Maraj-Naraynsingh contends that the two matters are the same, but the Director of Public Prosecutions is still pursuing with the criminal appeal.
