Police told bring Small to court
Lenville Small, who has been detained without charge under the Anti-Terrorism Act since November 18, 2005, was granted a writ of habeas corpus late yesterday evening by Justice Judith Jones. On three previous occasions, Small’s attorneys have attempted without success to have a judge issue a writ of habeas corpus, ordering Commissioner of Police Trevor Paul to bring Small to court. Small’s detention order, which was extended on two occasions by Justice Mark Mohammed, was supposed to end by midday today. The habeas corpus order was served on the police last night, and Small will have to be brought to court today at 11 am before Jones, when the police will have to explain their reason for detaining him without charge. On the last occasion on Monday, when ASP Paul Rodriguez had applied to Mohammed for the second extension order, Rodriguez had indicated that they may not seek a further extension. Small was arrested on November 18 after police raided his Gonzales home. The habeas corpus order stated that if the police failed to produce Small before the court today at 11 am, the court will commit Paul and others to prison for contempt in not obeying the order. Police said when they searched Small’s home, they allegedly found the names of several members of the legal profession with price tags on them.
