Six public servants sue for promotions


SIX senior public servants (PS) who were denied promotions to the post of Permanent Secretary and Deputy Permanent Secretary in six Government ministries have challenged the Public Service Commission’s (PSC) decision not to promote them.


The six acting Deputy PS are Diana Rutherford of the Education Ministry; Ashford Sankar of the Local Government Ministry; Chrisendath Mahabir of the Health Ministry; Terrance Jurawan of the Social Development Ministry; Keith Jackson of the Science, Technology and Tertiary Education Ministry; and Ashwin Creed of the Sports Ministry. The six PS were granted leave yesterday by Justice Amrika Tiwary-Reddy in the San Fernando High Court. They contended that they underwent an assessment by the Canadian Public Services Commission (CPSC) which was responsible for shortlisting public officers for the promotions.


When the matter came up for hearing yesterday in the Civil Court in San Fernando, attorney Anand Ramlogan argued that the six were unlawfully deprived of their legitimate expectations to be considered for promotion, though they had acted in the position for the past two years.


They are also seeking a declaration that the PSC’s recommendation of the CPSC’s assessment is illegal, null and void. They are contending that the failure to promote them is contrary to the principles of natural justice.
