Why is sodomy illegal?
In my humble opinion, this judgment goes beyond the scope of simply renaming a folly. It speaks volumes about brainwashing and the continued imposition of Christian-like ideologies on a multireligious society.
Justice Jamadar has given us a comprehensive approach to a longstanding anomaly.
It is to be noted that the preservation of existing laws by Section 6(1) of the TT Constitution infringes on fundamental rights of individuals, as previously demonstrated in the matter of the death penalty, re:Charles Matthew vs The State 2004, and now in the matter of the Trinity Cross.
While Section 6(1) saves existing laws from being unconstitutional, and therefore insulation against lawsuits, Parliament has arbitrarily decided to amend the law as regards the Trinity Cross. This is, in my view, primarily because Parliament wishes to appease a majority of the electorate of non-Christians; and secondly, because of Justice Jamadar’s pronouncement regarding discrimination.
However, similar findings in Matthew vs The State are of no real consequence in the eyes of Parliament, as persons afflicted by imposition of the mandatory nature of the death penalty are as yet, in the minority.
That aside, can someone please tell me why sodomy is illegal, and whether this law is also guarded by Section 6(1)?
