Sacked soldier sues Army

A SOLIDER who was kicked out of the Army has sued the Defence Force for breach of contract among other things.

Olatungii Belle enlisted in July 1998 and was kicked out on February 2, 2001. Belle, in his writ of summons, filed Friday by attorney Keith Scotland in the Registry of the Port-of-Spain High Court, wants damages for unlawful dismissal, a court order reinstating him, or an award of compensation, damages, interest and costs. Belle, who is now driving taxi for a living, claimed that on January 23, 2001, while a Private in the army, he was put under close arrest. He also claims he was assaulted by a Corporal who hit him in the face in the presence of other officers and placed him in a cell. He said he was later released by the Regimental Sergeant Major. Belle said he sought medical attention for the injuries sustained from the blow at the Arima Hospital.

On January 25, 2001, an army captain issued three charges against Belle — failing to comply, offering violence to a Corporal and damage to service property. The following day, Belle was remanded to see the Commanding Officer where he was sentenced to 14 days detention. Belle claimed he was not informed of his right to legal representation or any form of independent representation during the meeting with his CO. He also alleged that he was not allowed to freely and voluntarily examine or cross-examine his accusers. He was again remanded in custody until February 2, leaving his cell only on January 29, to visit the army doctor. Belle said that on February 2, 2001, he was orally dismissed from the Defence Force without any prior notice. He is contending that his dismissal was wrong and unlawful and in breach of his six years enlistment agreement, as well as the rules of natural justice. Belle is asking the court to say that his firing as punishment was harsh, excessive and contrary to the penalties set out for such offences in the Defence Force Act.
