Girl, 13, sues State

Attorney Asaf Hosein, who filed the case, is contending that the gate fell on top of Anjula and it pinned her to the ground. But the gate appeared to have been rotted and worn. As a result, the attorney contends that the Ministry of Education had not been ensuring that the gate was maintained. Anjula was rushed to the San Fernando General Hospital and, according to the lawsuit, after a CT scan was done, doctors transferred her to the Eric Williams Medical Sciences Complex in Mt Hope where she was placed on a ward.

Since the incident, Anjula has experienced severe headaches on the right side of her head, occasional dizziness, facial swelling on the right side and neck pain. A medical diagnosis, according to the lawsuit, lists the schoolgirl as a child who suffers from mild cerebral irritability which is more prominent on the left side of the head. It further went on to state that there has been some regression in respect of Anjula’s brainwave regulation.

In fact, the lawsuit further states that the impact of the gate falling on the child, has affected her psychologically.

She becomes frightened upon hearing the sound of an ambulance siren but, that apart, Anjula did not return to school until September 2014.

During the period she had been at home following the accident, she was unable to read and suffered regular blackouts. Hosein contended that the only inference that could be drawn from the accident is that the Ministry of Education was negligent by not ensuring that there were regular checks at school buildings in order to ensure their fitness. Anjula is seeking compensation for loss and personal injuries.
