Panday files for judicial review

BASDEO PANDAY has gone to the Port-of-Spain High Court seeking judicial review of the decision of the Chief Magistrate to dismiss yesterday’s submissions in the Port-of-Spain Eighth Magi-strates’ Court. The application for leave was filed at 3.55 pm yesterday in the Registry of the Supreme Court. However, no date has yet been fixed for the hearing of the application. Among the reliefs sought is a declaration that the decision of Chief Magistrate Sherman Mc Nicolls was unlawful and unreasonable.

Panday wants an order of prohibition to stop Mc Nicolls from continuing to hear three charges against him. Panday also wants an interim order to stop Mc Nicolls from hearing the charges until the determination of the judicial review matter. The judicial review application was filed by attorney Devesh Maharaj. Panday is before Mc Nicolls charged with failing to declare his London bank accounts to the Integrity Commission for the years 1997, 1998, and 1999.
