Ramesh takes Manning to Privy Council

Attorney Ramesh Law-rence Maharaj SC, instructed by Garnet Mungalsingh, was granted final leave to petition the Privy Council against a decision of the Court of Appeal in a matter complaining about Prime Minister Patrick Manning’s refusal to call election in 2001. Two citizens, Florence Bobb and Girly Moses, filed a constitutional motion claiming that Manning had breached the constitution when he decided to hold on to office after there was an 18/18 tie in the House of Representatives during  that year’s general election, instead of calling election when it was lawfully due.

The motion was dismissed by a lower court and the Court of Appeal. At yesterday’s hearing, however, Court of Appeal Justices Margot Warner, Stanley John and Ivor Archie granted final leave to appeal to the Judicial Committee of the Privy Council. The State was represented by Glennis Potts.
