Family sues WASA

A Water and Sewerage Authority (WASA) ruptured water main has become the subject of a lawsuit filed by a Spring Village, Valsayn family who yesterday sued the Authority for destruction of their dirt house. Kamanie Maloo, 31, filed a writ for negligence, in which she claimed $62,000 for the almost complete destruction of her house. In the writ, she claimed a ruptured water main caused the dirt house to become flooded and saturated with water, which caused it to crumble. Filed in the Sub-Registry in San Fernando, the writ also claims that Maloo lived in a three-bedroom house constructed of dirt and the house, though built several years ago, once stood stable and strong.


Filed by attorney Imran Khan, Maloo also stated that her mother Lutchmin, 69, and father Mahabal, 73, enjoyed quiet possession of the dirt house. On January 9, Maloo stated in her writ, a WASA main ruptured, causing water to flood the Spring Village area. Maloo said her dirt house became flooded. Three days later, the writ stated, WASA began repairing the main line. The writ also alleged that a water valve was not turned off properly after the repairs, resulting in Maloo’s home becoming flooded again. Maloo claimed the walls of the house were saturated and started crumbling. The roof has almost collapsed as a result of what court documents described as “cracking of the partitions.” Maloo is claiming $62,000 in damages plus legal costs.
