Lawsuit after cesspit fall

She said she had gone to the back of the property to the washing area when she fell. Mohammed’s lawsuit filed by attorneys Kavita Sarran and Douglas Bayley, claims she was submerged in raw sewage, which went into her nose and mouth as she sank into the cesspit. She also felt cockroaches crawling on her face.

As she screamed for assistance, CEPEP workers came to her aid and pulled her out. She immediately began vomiting and was assisted to a nearby pipe where she was washed down. Mohammed was later taken to hospital where her cuts were cleaned and she was prescribed antibiotics.

The next day she returned to hospital with a high fever after developing an infection.

In their reply, the Alis through their lawyer Robin Ramoutar, denied the allegations and said a laundry area was provided in a portion of the garage so there was no need for Mohammed to go to the area where the cesspit was located.

“Your client was the author of her own misfortune by walking on the lid when she had no reason to do so and caused same to break. Further, your client is a person of sizeable heft and should have taken care for her own safety by not walking onto the lid of the septic tank,” attorney Ramoutar wrote on behalf of his clients.

The couple denied Mohammed was submerged in untreated human faeces and said owing to her size, she did not fall into the cesspit completely but was only lodged in the opening of the lid, which gave way under her weight. They also said they took her to hospital and bought medication for her.
