Breaches of UNC constitution

I have already pointed out that under Article 12(iv)d) Members of Parliament Dr Tim Gopeesingh and Chandresh Sharma are illegally holding on to the positions of CEO and COO, as the Constitution of the Party specifically forbids such appointments.

What is quite worrying is that Dr Gopeesingh should know better, he having been a member of the constitution committee. Sharma just does not know! I await a reply from the General Secretary of the Party on this matter.

I wish to look at the dismissal from the Executive of Manohar Ramsaran as the Central Regional Representative for allegedly missing three meetings without reasonable excuse, Article 19(c). However Article 12(iv) states that the National Executive shall meet at least once per month.

The framers of the constitution clearly did not envisage weekly meetings! The cabal is evidently acting against the spirit of the constitution when they could use three weekly meetings to dismiss someone. Members should also note how convenient it was for certain persons to postpone these ‘important’ meetings during the World Cup in Germany because the jefes had to enjoy football.

I wish to quote directly from Basdeo Panday in a presentation of the Constitution when he said, “In determining the nature and purport of these rules and regulations one must be informed by the aims and objectives of the organisation.

The rules and regulations must conduce to those aims and objectives and not operate against them.”

Clearly the framers of the constitution wanted to protect members from the arbitrary misuse of power, and not invoke three strikes and you are out or to play by the letter of the law. If this were not so then a crazy group calling themselves an executive could call a meeting every day of the week and then expel someone for missing three consecutive meetings. Members should enquire if any member of the party was removed from such a post at any time in the history of the party and then one would gain a fuller appreciation of the ulterior motives of the cabal. Having illegally removed Manohar Ramsaran, the cabal goes further by replacing a person who was voted into office by the membership of the party by someone who the membership voted against.

It is clearly an absurdity to redirect the votes of the party membership and quite obviously an attempt to upstage the democratic process. Article 12, which deals with the national executive states sec (r) propose to the national congress for its approval the holding of elections for officers within it notwithstanding that their term has not expired otherwise than in cases of casual vacancy. If even the cabal was correct in firing Manohar Ramsaran, which quite clearly they are wrong, his vacancy can only be filled at a bye-election, not by an appointment to such an important post.

The continued rape of the constitution clearly demonstrates that our party has been hijacked and the perpetrators of these blatant acts of injustice are afraid to face the party membership at free and fair elections.
